Terms of Service

In short

These terms are a contract, so the full version follows. We have tried to keep it readable.

1. Who we are and what this covers

Amana is operated by Tessera42 Ltd, trading as Amana, a company registered in England and Wales, company number 17405769, registered office Suite RA01, 195-197 Wood Street, London, E17 3NU, United Kingdom. In these terms, "we", "us" and "Amana" mean that company. "You" means you, the account holder.

These terms govern your use of the Amana mobile app and website. By creating an account you agree to them. If you do not agree, please do not create an account.

Our Privacy Policy explains what we do with your information and forms part of these terms.

2. Who can use Amana

You must be 18 or over to hold an Amana account.

You must give us a real email address that you control, and accurate information when you sign up. You may hold only one account for yourself.

Amana is currently in closed beta and available by invitation only. We may end your access at the end of the beta period, subject to clause 15.

3. What Amana is

That is the service. We will add features over time, and we may change or remove features, as described in clause 14.

4. What Amana is not

This matters, so please read it.

4.1 Amana is not a password manager. Do not store passwords, PINs, security question answers, master keys or recovery phrases in Amana. It is not built for that and we will never add it. Use a dedicated password manager instead.

4.2 Amana does not give advice. Nothing in the app is legal, medical, financial, tax or immigration advice. Storing a document does not mean we have reviewed it, checked it is valid, or noticed that it is about to expire beyond any reminder you set yourself.

4.3 Amana is not a backup service. It is a place to organise and find things. It is not a substitute for keeping your own copies. See clause 12.

4.4 A scan is not the original. A photograph or scan of a passport, will, deed, certificate or contract is a copy. It has no legal force on its own and it will not be accepted where an original is required. Keep your original documents safe somewhere physical. Amana helps you know what you have and where it is. It does not replace it.

4.5 Amana is not an emergency service. Do not rely on it for anything time-critical or life-critical.

5. Your account

5.1 You are responsible for keeping your password secret and for everything that happens under your account. Choose a password of at least 12 characters that you do not use anywhere else.

5.2 Tell us promptly at support@myamana.app if you think someone else has got into your account.

5.3 Do not share your account with anyone. If you want someone else to see your documents, use the Helper feature in clause 7, which is designed for it, keeps you in control, and shows you what they did.

5.4 We may need to email you about your account: to confirm your email address, reset your password, or tell you about a Helper change or a security issue. These are not marketing and you cannot opt out of them while you hold an account.

6. What you may and may not upload

6.1 You may upload documents and images that you own, that belong to your household, or that you have a genuine reason to hold, in the file types the app accepts.

6.3 Documents about other people. People routinely use Amana for a parent's, partner's or child's documents, and that is expected. If you do it for your own family and household, that is your business and we do not police it. If you are acting professionally, as a carer, adviser, attorney or in any other formal role, you are responsible for meeting whatever obligations apply to you.

6.4 We do not monitor, scan or review what you upload. We have no ability to read the contents of your files as part of normal operation. If we are made aware of content that breaches clause 6.2, we may remove it and suspend your account under clause 15.

7. Helpers

7.1 You may invite one trusted person to have read-only access to your vault. The limit may change as the product develops.

7.2 A Helper can view your documents. They cannot edit, delete or add anything, and cannot invite anyone else.

7.3 Everything your Helper does in your vault is recorded in your activity log, and you can see it.

7.4 You can revoke a Helper's access at any time, immediately, without giving a reason and without their agreement. This is a core promise of the product and we will not change it.

7.5 Inviting someone means giving them sight of your documents. Choose carefully. We cannot undo what someone has already seen or remembered, and we are not responsible for what a Helper does with what they see.

7.6 If you are a Helper, you must only use your access to help the person who invited you, and only for the purposes they intended.

8. Who owns what

8.1 Your documents are yours. You keep every right in everything you upload. We claim no ownership of any of it.

8.2 To operate the service we need your permission to handle your files. You grant us a limited, non-exclusive, royalty-free licence to store, encrypt, back up, transmit and display your content, solely so that we can provide Amana to you and to any Helper you have authorised.

8.3 That licence is limited to running the service, and to nothing else. In particular, we will not use your content to train artificial intelligence or machine learning models, we will not use it for marketing, advertising, research or analytics, we will not sell or licence it to anyone, and we will not use it to build any other product. We commit to this in these terms so that it is a binding promise rather than a policy we could change quietly.

8.4 The licence ends when you delete the content or your account, subject only to the retention periods in the Privacy Policy.

8.5 The Amana app, website, name, logo and design are ours. You may not copy, resell, reverse-engineer or make derivative works of them.

9. Feedback

If you send us suggestions or feedback about Amana, we may use them freely to improve the product, without owing you payment or credit. This applies to ideas about the product only. It gives us no rights whatsoever over your documents.

If you find a security vulnerability, please tell us at support@myamana.app rather than exploiting it. We will not pursue anyone who reports a genuine issue responsibly and in good faith.

11. Beta terms

While Amana is in beta:

11.1 It is free. No payment is required and no card details are collected. We may introduce paid plans later, and we will not charge you for anything without asking first.

11.2 There is no service level commitment. No uptime guarantee, no response time guarantee, no guarantee that any feature keeps working.

11.3 Things will break. Beta software has bugs. Features may change or be removed without notice.

11.4 We may end the beta, or end your participation, at any time. If we do, clause 15 applies and you will get your data out.

11.5 Your data carries over. If Amana launches properly, your account and documents come with you. We will not wipe beta accounts at launch.

12. Keep your own copies

Please do not make Amana the only copy of any document you cannot afford to lose.

We take reasonable care. We use professional infrastructure providers, we encrypt what we describe in the Privacy Policy, and deletion is deliberate rather than accidental. But no service is immune to failure, and this one is in beta and run by a very small team.

Keep your original documents. Keep a second copy of anything critical. Amana is here to help you find things and stay organised, not to be the last line of defence for your most important papers.

13. Our responsibility to you

13.1 What we do not limit. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. If you are a consumer, nothing here affects your statutory rights, including your rights under the Consumer Rights Act 2015 to have a service provided with reasonable care and skill.

13.2 What we will do. We will provide Amana with reasonable care and skill.

13.3 What we are not liable for. To the extent the law allows, we are not liable for loss of profit, loss of business, loss of opportunity, or any indirect or consequential loss. We are not liable for loss or damage caused by something outside our reasonable control, by your failure to keep your own copies as clause 12 asks, by your password being compromised through no fault of ours, or by what a Helper you chose to invite does with access you chose to give them.

13.4 The cap. Where we are liable, and to the extent the law allows us to cap it, our total liability to you for all claims connected with these terms is limited to the greater of the amount you have paid us in the twelve months before the claim, or £100.

13.5 Why the cap is low. Amana is currently free. We are being straightforward that a free beta from a small company cannot carry unlimited financial risk. That is exactly why clause 12 asks you to keep your own copies, and why we would rather say so than bury it.

14. Changes

14.1 To the service. We may add, change or remove features. If we remove something you rely on, we will give reasonable notice where we can.

14.2 To these terms. If we make a change that materially affects your rights, we will email you at least 30 days before it takes effect. If you do not accept it, you may close your account and download your documents before it applies. Continuing to use Amana after that date means you accept the new terms. Minor corrections we will simply make, and the date at the top will change.

15. Ending it

15.1 You can leave at any time. Delete your account in Settings. No reason needed, no notice period. Your data is permanently erased after 30 days, as described in the Privacy Policy, and you can change your mind within that window.

15.2 We may suspend or close your account if you materially breach these terms, if we are required to by law, or if your use puts the service or other users at risk. Except where the law prevents it or where there is a serious and immediate risk, we will tell you why and give you a chance to put it right.

15.3 If we close the service we will give you at least 30 days' notice and a way to download everything before it goes.

15.4 Clauses 8, 9, 13, 16 and 17 survive the ending of these terms.

16. Law and disputes

16.1 These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.

16.2 If you are a consumer, clause 16.1 does not take away any protection given to you by the mandatory law of the country where you live. You may also bring proceedings in your own country, and you keep any right you have there to complain to a local consumer or data protection authority.

16.3 Please contact us at support@myamana.app first. Nearly everything can be sorted out that way, and we would rather fix a problem than argue about it.

17. Everything else

17.1 These terms and the Privacy Policy are the whole agreement between us about Amana.

17.2 If any part of these terms is found to be unenforceable, the rest continues to apply.

17.3 If we do not enforce something straight away, that does not mean we have given up the right to enforce it later.

17.4 You may not transfer your rights under these terms to anyone else. We may transfer ours if Amana is sold or reorganised, and we will tell you if that happens.

17.5 These terms do not give rights to anyone other than you and us.
